What are fundamental rights?,why do we say these rights are fundamental?. Of course,certain rights,privileges,duties and liabilities are provided in different laws existing in Nigeria, there are however some rights which are inseparable from the individual and as such are termed 'Fundamental'. This rights are special,specific and are contained under chapter iv of the constitution of the Federal Republic Of Nigeria. Some of the rights are as follows;
•Right to life: section 33(1) of the constitution of the federal republic of nigeria(herein after referred to as CFRN) provides that everyone has a right to life,and no one shall be deprived intentionally of his life,save in execution of the sentence of a court in respect of a criminal offence which he has been found guilty in Nigeria.
However,it is important to note that while the right to life of an individual is fundamental,such right cannot be said to have been breached if the nature of this said breach is one done in the manner as contained under sub-section(2) of section33. Sub-section(2) provides thus;
"Any person shall not be regarded as having been deprived of his life in contravention of this section,if he dies as a result of the use,to such extent and in such circumstance as are permitted by law of such force as is reasonably neccessary-
( a) for the defence of any person from unlawful violence or the defence of property;
(b)in order to effect a lawful arrest or to prevent the escape of a person lawfully detained;or
(c)for the purpose of suppressing a riot,insurrection or mutiny.
